FLUX-OS PROPRIETARY SOFTWARE LICENSE AGREEMENT

1. PREAMBLE
This License Agreement ("Agreement") is a legal agreement between you ("Licensee") and Oliver Lebaigue ("Licensor") for the use, reproduction, and distribution of the software known as "FLUX-OS" (the "Software").

By installing, copying, accessing, or otherwise using the Software, Licensee agrees to be bound by the terms of this Agreement. If Licensee does not agree to the terms of this Agreement, Licensor is unwilling to license the Software to Licensee, and Licensee may not use the Software.

2. DEFINITIONS
2.1 "Software" shall mean the FLUX-OS operating system, including but not limited to the kernel source code, bootloader, graphics libraries, build scripts, documentation, object files, binary executables, ISO images, and any associated media or printed materials.
2.2 "Derivative Work" shall mean any work based upon the Software or any portion thereof.
2.3 "Source Code" shall mean the preferred form of the Software for making modifications to it.
2.4 "Object Code" shall mean any form resulting from mechanical transformation or translation of the Source Code.

3. GRANT OF LICENSE
3.1 Limited License. Subject to the terms and conditions of this Agreement, Licensor hereby grants to Licensee a non-exclusive, non-transferable, revocable license to use the Software for personal, educational, and non-commercial evaluation purposes.
3.2 Restrictions. Licensee may NOT: (a) Redistribute the Software. (b) Use the Software for commercial purposes. (c) Modify, adapt, translate, reverse engineer, decompile, disassemble, or create Derivative Works. (d) Remove or alter proprietary rights notices. (e) Use the Software to develop competing systems.

4. INTELLECTUAL PROPERTY RIGHTS
4.1 Ownership. Licensor retains all right, title, and interest in and to the Software.
4.2 Reservations. Licensee acknowledges that the Software contains valuable trade secrets.

5. CONFIDENTIALITY
Licensee agrees to maintain the confidentiality of the Source Code.

6. NO WARRANTY
6.1 Disclaimer. THE SOFTWARE IS PROVIDED "AS IS". LICENSOR DISCLAIMS ALL OTHER WARRANTIES.
6.2 No Technical Support. Licensor is under no obligation to provide support.

7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF THE USE OF THE SOFTWARE.

8. TERMINATION
This Agreement is effective until terminated. Upon termination, Licensee shall destroy all copies.

9. EXPORT CONTROL
Licensee agrees to comply with all applicable export control laws.

10. MISCELLANEOUS
This Agreement shall be governed by the laws in which Oliver Lebaigue resides.
